SMS Terms & Conditions
Welcome to the Terms an Conditions of Taxi 131-008 Limited's (the "Company") SMS 1999 0008 Taxi Booking Service (the "Service"). These Terms and Conditions were last updated on 1 March 2011. These Terms and Conditions may be updated from time to time and any changes will be effective from the date of posting. Please check back regularly to see the current Terms and Conditions. The Service is owned and operated by Taxi 131-008 Limited.
By using the Service, you agree to these Terms and Conditions.
Description of the Service
The Company provides an SMS taxi booking request service. The Service is only available in the cities/towns listed on the 131008 website: www.131008.com/sms. The Service is for immediate taxi bookings only. Please go to www.131008.com/sms for information on how to use the Service. The Company is not a taxi service, rather it provides the SMS gateway for its member taxi services. It is the Company's member taxi services that will confirm or decline your booking request and ultimately be responsible for the provision of a taxi.
Access to the Service
In order to use the Service you must have bill payer's permission. You must also have a mobile communications subscription with a participating carrier or otherwise have access to a mobile communications network for which the Company makes the Service available, and pay any service fees associated with any such access. In addition, you must provide all equipment and software necessary to use to the Service, including, but not limited to, a mobile handset or other mobile access device that is in working order. You are responsible for ensuring that your equipment and/or software do not disturb or interfere with the Company's operations. Any equipment or software causing interference shall be immediately barred from further access to the Service.
Interruptions or Discontinuation of the Service
The Company may suspend the Service for repair, maintenance, and/or upgrade work. The Company reserves the right, at its sole discretion, to modify or discontinue, temporarily or permanently, an individual's access to the Service. The Company also reserves the right to modify or discontinue, temporarily or permanently, the Service for a particular taxi service district, or nationally.
Charges
For each SMS sent to the Service, the sender will incur a standard SMS charge, regardless of the success or failure in processing the message or of the success or failure of procuring a taxi. If your booking request is confirmed by the relevant taxi service, an additional processing fee of $1.50 (the "Fee") will be charged. The Fee is in addition to any other taxi booking or other fee that the taxi service may charge. The Fee is not refundable, even if the taxi service fails to provide you with a taxi in a time and manner that is to your satisfaction, or you cancel your booking. The Company reserves the right to change the Fee without notice. The Fee will be charged to you by your mobile phone provider and will appear as a charge on your mobile phone bill.
Privacy
You acknowledge that the Company collects and processes "personal information" such as mobile phone number and your pickup address/s and that this information is passed on to one of the Company's member taxi services in the process of procuring a taxi. We may pass on your information to governmental agencies, including but not limited to courts and district attorneys' offices, for legal proceedings and the prevention of crimes.
Disclaimer
The Company does not accept responsibility for the failure of a member taxi service to provide a taxi in a time and manner that is to your satisfaction, or you cancel your booking.
Indemnification
You agree to indemnify and hold the Company, its subsidiaries, affiliates, officers, agents, directors, contractors, licensors and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of or in connection with (a) your use of the Service, and (b) the breach by you of your representations and warranties set forth herein.
